OF MONTGOMERY CITY COUNCIL
REGARDING CORONAVIRUS
MARCH 27, 2020

The Council of the City of Montgomery met by teleconference Friday, March 27, 2020, at 4:00 p.m.  The following Council members participated in the teleconference:

PRESENT: BOLLINGER, LYONS, GRAHAM, CALHOUN,
                      MITCHELL, MCINNIS, PRUITT, JINRIGHT --8

ABSENT: LARKIN --1

Council President Jinright served as Chairman of the meeting and Brenda Gale Blalock, City Clerk, served as Clerk of the meeting.

The Clerk stated the item under discussion was a Resolution regarding the Families First Coronavirus Response Act, as follows, and that voting would be done by roll call.  

RESOLUTION NO.  _____________
A RESOLUTION BY THE CITY COUNCIL 
REGARDING THE FAMILIES FIRST CORONAVIRUS RESPONSE ACT 

WHEREAS, on March 18, 2020, the Families First Coronavirus Response Act (hereinafter, “FFCRA”) was signed into law, and
WHEREAS, Division C of FFCRA, entitled Emergency Family and Medical Leave Expansion Act, expands the Family Medical Leave Act to include eligible employees who are unable to work (or telework) due to a need to care for their child when the school or place of care has been closed, or the regular childcare provider is unavailable due to a public health emergency with respect to COVID-19; and
WHEREAS, Division E of FFCRA, entitled Emergency Paid Sick Leave Act, entitles all eligible employees unable to work (or telework) up to 80 hours of paid sick leave available to use for qualifying reasons as further specified in Sec. 5102(a) of the Act; and 
WHEREAS, pursuant to the Act, an employer of an emergency responder may elect to exclude such employee from either division of the Act; and  
WHEREAS, the City Council for the City of Montgomery believes it is in the best interest of the citizens of the city and its emergency responders to include emergency responders in the provisions of  Sec. 5102(a) of the Act but exclude them from the provisions in the amendments made under Sec. 3102 of the Act;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MONTGOMERY, ALABAMA, that emergency responders shall be included in the provisions of  Sec. 5102(a) of the Act but excluded them from the provisions in the amendments of the Family Medical Leave Act made under Sec. 3102 of the Act.
City Attorney Stacy Bellinger briefed the Council on the purpose and procedures of the resolution.  Mayor Reed answered questions by the Council.

Councillor Pruitt asked Chief Finley and Chief Jordan if they were in agreement with the resolution.  Chief Jordan stated he was in agreement with the resolution.  Chief Finley stated he was in agreement with the resolution.

Councillor Graham made a motion to suspend the rules in order that the proposed resolution could be placed upon final passage, which motion carried by the following:

MITCHELL, MCINNIS, PRUITT, JINRIGHT --8
NAYS: NONE --0
ABSTAINED: NONE --0
ABSENT: LARKIN --1 

The rules having been suspended, Councillor Bollinger made a motion to adopt said resolution, which motion carried with the following vote:

AYES: BOLLINGER, LYONS, GRAHAM, CALHOUN,
MITCHELL, MCINNIS, PRUITT, JINRIGHT --8
NAYS: NONE --0
ABSTAINED: NONE --0
ABSENT: LARKIN --1 

The Chairman asked Mayor Reed if he had anything further.  Mayor Reed stated he will be imposing a curfew indefinitely from 10 p.m. to 5 a.m. beginning this evening and asked for the Council feedback on the proposed curfew.

The Council was unanimous in their support of the curfew, which vote was as follows:

MITCHELL, MCINNIS, PRUITT, JINRIGHT --8
NAYS: NONE --0
ABSTAINED: NONE --0
ABSENT: LARKIN --1 

There being no further business to come before the Council, the teleconference adjourned at 4:14 p.m.
