OLD BUSINESS
1. Mayoral Veto of Ordinance No. 51-2024 (Approval of Contracts). Reasons: 1. Council review and approval of all city contracts above $50,000 creates an environment where the politicization of the contracting process can occur among council members, thus undermining the spirit of collaboration and equity across the City of Montgomery at large. 2. The review and approval of subject contracts creates an unnecessary layer of bureaucracy to a system that features numerous checks and balances adopted by subject matter experts and professionals on the city’s staff. The Council’s new review and approval policy, at minimum, will add an additional two weeks to the contract execution process averaging 28 days to complete. 3. Referencing state contracting law, the aforementioned increase in processing time will place the city in jeopardy of renegotiating competitively bid contracts; whereas, a bid proposal is only valid for 30 calendar days. After the period has expired, the selected contractor can compel the city to renegotiate at a higher rate. Over time, the accumulation of renegotiated fees could cost the city tens of thousands to millions of dollars in unnecessary fees and charges. 4. Summarily, the Mayor’s office and city departments have proven to be trustworthy and transparent with the Council when it comes to contracting and the expenditure of funds. This ordinance will greatly diminish effectiveness and efficiency, while undermining the trust placed in the mayor and the professionals who serve the City of Montgomery.

5. Ordinance amending Section 3-9 of the Code of Ordinance – Hours of Sale of Alcoholic Beverages.
6. Ordinance rezoning 5 parcels containing 9.5 acres (+/-) located on the south side of Edna Brake Lucas Drive, approximately 600 feet west of Sprott Drive, from an AGR-1 (Residential Agriculture) Zoning District to an M-1 (Light Industrial) Zoning District. Planning Commission made NO RECOMMENDATION. There was no 2nd to the motion to approve; therefore, no action was taken. (RZ-2024-019)
7. Ordinance rezoning one lot located on at the northeast corner of Atlanta Highway and Wares Ferry Road (aka 3701 Atlanta Highway) from an O-2 (Office) Zoning District to a B-2-Q (Commercial-Qualified) Zoning District; restricted to a Daycare. Application requested B-2; Planning Commission recommended B-2-Q; restricted to a Daycare. No appeal received. (RZ-2024-020) WITHDRAWN BY APPLICANT.
8. Ordinance Rezoning two lots on the north side of Yarbrough Street, approximately 160 feet west of Broadview Street (aka 1751 Yarbrough Street) from an R-65-d (Duplex Residential) Zoning District to a B-2-Q (Commercial-Qualified) Zoning District; restricted to a Small Outdoor Café and Bistro. Applicant requested B-2; Planning Commission Recommended B-2-Q (Commercial-Qualified) restricted to a small outdoor café and bistro. No appeal received. (RZ-2024-021)
10. Resolution encouraging all supporting municipalities to adopt a resolution encouraging Alabama Legislature to adopt legislation supporting photo identification for concealed carry and providing penalties. (Sponsored by Councillor Pruitt)
11. Application for a Towing Company by Christopher Thorn, d/b/a Clutch Roadside & Auto, no physical location.
12. Resolution repealing the legislation which created Montgomery City/County Personnel Board and expressing Council’s intent to adopt an ordinance creating a City Personnel Board in accordance with Act 2024-337.
