October 3 Council Meeting Summary

The following City Council Agenda Items were heard during October 3rd, meeting:

 

The City Council Chairman appointed the following Ad-Hoc Committee on Vacant/Abandoned structures; Neighborhood Revitalization Progress; and Enforcement of Business License Code; Appointed to the Committee were: Councilman Larkin, Councilman Green, Councilman Lee.

 

The Following items were placed into the Ad-Hoc committee for investigation: 

  • Ordinance amending the Code of Ordinances Chapter 12, Article II Nuisances to create a new division entitled Vacant and Abandoned Structures Registration; to require property owners of vacant structures to register properties; to establish minimum standards of care and upkeep for the buildings and established penalties for violations.  (Sponsored by Councillor Larkin)
  • Resolution providing for the establishment of the City of Montgomery Neighborhood Services Department and the creation of the City of Montgomery Neighborhood Revitalization Program.  (Sponsored by Councillor Larkin)
  • Resolution providing for Enforcement of Business License Code and Schedules of Licenses known as the Montgomery business License Code and Uniform Revenue Procedures pertaining to same applicable to the Lease or Rental of Residential or Non-residential Real Estate within the Corporate Limits of the City of Montgomery.(Sponsored by Councillor Larkin)

The following items have been Withdrawn:

  • Ordinance amending Code of Ordinances Chapter 12, Article II, Section 31 providing for the establishment, implementation and enforcement of a Residential Rental Business License and Inspection program; defining terms; providing requirements, procedures, and fees for the registration and inspection of non-owner occupied rental property in the City; providing penalties for violations and providing appeal process for the denial or revocation of a Certificate of Registration.  (Sponsored by Councillor Larkin)
  • Resolution revoking Business License for failure to pay Sales Tax and authorizing Show Cause Hearing for Lalonie Farnell, d/b/a Lotus Stores, 6832 Eastchase Parkway. (Store already closed)

     

    The following Applications were approved by the City Council:

  • Application for a Retail Beer (On or Off Premises) License by El Taco Shop Inc., d/b/a El Taco Shop, 3271 Malcolm Drive.

The following Ordinance has been approved by the City Council:

  • Ordinance increasing the Lodging Tax
  • Ordinance amending FY 2017 Operating and Debt Service Budget and adopting FY 2018 Operating and Debt Service Budget. 
  • Ordinance amending Ordinance No. 24-2004 modifying the restrictions for the property located at 4695 Vaughn Road in a B-3-Q (Commercial-Qualified) Zoning District.  Recommended by the Planning Commission.  (RZ-1975-057)
  • Ordinance amending Ord. No. 3-2003 revising the Master Plan to change office and commercial to single-family residential for property located on the northeast corner of Young Meadows Road and Berrydale Drive in a PUD (Planned Unit Development) Zoning District.  Recommended by the Planning Commission.  (RZ2013-009)   

 

The following Resolutions were adopted by the City Council:

  • Resolution declaring no further action needed regarding the Business License of Laurekisha Blakely, d/b/a Limitless Options Boutique, 710 Forest Avenue.
  • Resolution denying and/or revoking right to operate a business for failure to purchase Business License:  Fredrick Stewart, d/b/a Stewart Imports and Exotics LLC, 4928 Catherine Drive.
  • Resolution revoking Business License for failure to pay Sales Tax and authorizing Show Cause Hearing for Steve Chambers, d/b/a It’ll Do Tavern, 557 North Eastern Boulevard.
  • Resolution amending Resolution No. 629-75 Section 3. Membership of Montgomery Clean City Commission.
  • Resolution declaring public nuisances, authorizing immediate abatement and assessing cost of abatement of public nuisances on various lots pursuant to Chapter 12 of Code of Ordinances. 

    The following items have been brought into compliance therefore made Moot:

  • Show Cause Hearing on the proposed finalization of the revocation of the Business License of Brian Moore, a/k/a B and D Hospitality Inc., d/b/a Tenda Chick, 5951 Atlanta Highway.
  • Show Cause Hearing on the proposed finalization of the revocation of the Business License of Jesse Buckner, d/b/a Smooth Vapor, 6536 Atlanta Highway.

     

    The following Resolutions were substituted and Adopted:

     

  • Resolution declaring no further action needed regarding the Business License of Jesse Buckner, d/b/a Smooth Vapor, 6536 Atlanta Highway.
  • Resolution declaring no further action needed regarding the Business License of Brian Moore, a/k/a B and D Hospitality Inc., d/b/a Tenda Chick, 5951 Atlanta Highway.
